2. Gmail Integration and Email Services

Our platform integrates with Gmail to provide email services:

• OAuth 2.0 authentication with your Gmail account
• Gmail API access with gmail.modify scope to read, compose, and send emails
• Basic profile access with userinfo.profile scope to see your personal information
• Storing encrypted OAuth tokens for service access

Important: You must have a valid Gmail account and grant us permission to access it for our services to function. We only request the minimum required permissions needed to provide our email services. You can revoke this access at any time through your Gmail account settings.

3. User Responsibilities and Compliance

As a user of ConverMail, you are responsible for:

• Ensuring you have permission to contact prospects in your database
• Complying with all applicable email marketing laws and regulations
• Maintaining accurate and up-to-date prospect information
• Using our services in accordance with Gmail's terms of service
• Not engaging in spam, phishing, or other malicious activities

4. Email Sending Risks and Disclaimers

Important Risk Disclaimer: While ConverMail helps you scale your cold email outreach, there are inherent risks associated with sending large volumes of emails that users must understand and accept.

• Gmail Account Restrictions: Sending too many emails may result in your Gmail account being flagged, restricted, or banned by Google
• Email Deliverability: High-volume sending can affect email deliverability and may result in emails being marked as spam
• Platform Limitations: Google may impose sending limits or require additional verification for high-volume accounts

Risk Mitigation: ConverMail implements algorithms and best practices to reduce these risks, including:

• Intelligent sending schedules to optimize email delivery timing
• Rate limiting to prevent overwhelming Gmail's sending limits

Risk Acknowledgment: By using our services, you acknowledge that:

• Email sending risks exist regardless of our mitigation efforts
• Google's policies and restrictions are beyond our control
• You use our services at your own risk
• ConverMail cannot guarantee that your Gmail account will not face restrictions

5. Limitation of Liability

To the maximum extent permitted by law, ConverMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Gmail account restrictions, suspensions, or bans
• Email deliverability issues or spam filtering
• Damages resulting from email marketing compliance violations
• Any losses related to prospect data or campaign performance

Our total liability for any claims arising from the use of our services shall not exceed the amount you paid for our services in the 12 months preceding the claim.

6. Data and Privacy

Your data privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of your prospect data and email content. We process this data only to provide our services and in accordance with our Privacy Policy.

7. Account Termination

You may terminate your account at any time by contacting [email protected]. Upon termination:

• Your access to our services will be immediately suspended
• We will delete or anonymize your personal data at our discretion
• Any remaining subscription fees are non-refundable

8. Changes to Terms

Continued use of our services after changes become effective constitutes acceptance of the new Terms.
